By accessing or using the website located at www.fixyte.com (the "Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Site. These Terms apply to all visitors, including business representatives evaluating Fixyte Systems, LLC ("Fixyte," "we," "us," or "our") as a potential contract manufacturing partner.
2. Nature of the Site
The Site is an informational and lead generation website for Fixyte Systems, LLC, a precision contract manufacturer specializing in low-to-mid volume assembly and integration of complex optical, photonic, and electromechanical systems. The Site is intended for business professionals and does not constitute an offer to enter into any contract or agreement.
Actual manufacturing services are governed exclusively by separately executed Statements of Work (SOW) and Master Services Agreements (MSA) between Fixyte and its customers. Nothing on this Site creates a binding obligation on Fixyte to provide services.
3. Intellectual Property
All content on this Site – including text, graphics, logos, images, and downloadable materials – is the property of Fixyte Systems, LLC or its licensors and is protected by applicable copyright and intellectual property laws.
You may view and download materials from the Site for personal, non-commercial use in connection with evaluating Fixyte as a potential business partner. You may not reproduce, distribute, modify, or republish Site content without prior written consent from Fixyte.
4. Submissions and Communications
When you submit information through our contact form, email, or Calendly scheduling link, you grant Fixyte permission to use that information to respond to your inquiry and evaluate program fit. You represent that any technical or business information you share is either non-confidential or that you are authorized to share it.
For confidential program discussions, we recommend executing a Mutual Non-Disclosure Agreement (MNDA) prior to sharing proprietary technical details. Fixyte has a standard MNDA available upon request.
5. No Warranties
The Site and all content are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
Fixyte does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. We reserve the right to modify, suspend, or discontinue the Site at any time without notice.
6. Limitation of Liability
To the fullest extent permitted by law, Fixyte Systems, LLC and its members, managers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of, or inability to use, this Site or its content – even if Fixyte has been advised of the possibility of such damages.
Our total liability to you for any claim arising out of your use of the Site shall not exceed one hundred dollars ($100.00).
